These Terms and Conditions set out the basis on which Rubbish Removal Kennington provides rubbish collection and related waste clearance services to domestic and commercial customers. By placing a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, company or organisation requesting rubbish removal or related services from Rubbish Removal Kennington.

Services means rubbish removal, waste collection, waste clearance, bulky item disposal and any associated services provided by us.

Waste means any rubbish, refuse, junk, unwanted items, furniture, appliances, garden waste or other materials that the Customer asks us to collect, subject to these Terms and applicable waste regulations.

Booking means a confirmed request for Services made by the Customer and accepted by Rubbish Removal Kennington.

We, Us, Our means Rubbish Removal Kennington, the provider of the Services.

2. Scope of Services

Rubbish Removal Kennington provides waste collection and rubbish removal services to residential and commercial properties within our operating area. The type and scope of the Services will be agreed at the time of booking based on the information provided by the Customer about the Waste, property access and any special requirements.

We reserve the right to decline any request for Services where the Waste is not suitable for collection, the location is unsafe, or where providing the Services would breach any applicable law or regulation.

3. Booking Process

3.1 Bookings may be made by telephone, email, or via any booking system we make available. The Customer must provide accurate and complete information regarding the type, quantity and location of the Waste, property access details, and any relevant restrictions such as parking, time limitations or building rules.

3.2 We will provide an estimate or quote based on the information supplied. All quotes are given in good faith but may be subject to change if the Waste differs significantly from the description provided or if access is more difficult than indicated. Any substantial change in the price will be discussed with the Customer before the work is carried out.

3.3 A Booking is only confirmed once we have accepted the request for Services and provided a date and time window for collection. We may require confirmation by email, message or other written form, as specified to you at the time of booking.

3.4 The Customer must ensure that someone aged 18 or over is present at the property at the agreed time to provide access and authorise the work, unless otherwise agreed in advance.

4. Prices and Payments

4.1 All prices are quoted in pounds sterling and, unless expressly stated, are exclusive of any applicable taxes which will be added at the rate in force at the time of invoicing where required by law.

4.2 Our charges are typically based on the volume, weight and type of Waste, along with the labour required, any special handling, and disposal costs. Additional charges may apply where there are access difficulties, delays caused by the Customer, or where additional services are requested on site.

4.3 Payment is due on completion of the Services unless we have agreed alternative payment terms in writing before the Booking. We may accept cash, card payments, bank transfer or other payment methods advised to you at the time of booking.

4.4 For commercial Customers, we may issue invoices with agreed credit terms. If payment is not made by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in pursuing late payment.

4.5 Until full payment is received, we reserve the right to suspend future bookings for the Customer and to exercise any other rights we may have under these Terms or applicable law.

5. Cancellations and Amendments

5.1 The Customer may cancel or amend a Booking by contacting us as soon as possible. Cancellations or significant changes made less than 24 hours before the scheduled collection time may incur a cancellation fee, which helps cover administrative, staffing and scheduling costs.

5.2 If we arrive at the property at the agreed time and are unable to carry out the Services because the Customer is not present, access is not available, or the Waste is substantially different from the description provided, we may treat this as a short-notice cancellation and charge a call-out or cancellation fee.

5.3 We may cancel or reschedule a Booking if we are unable to attend due to events beyond our reasonable control, such as severe weather, traffic disruption, accidents, staff illness, vehicle breakdown or legal restrictions. In such cases, we will inform the Customer as soon as reasonably practicable and offer a new appointment time. We will not be liable for any loss arising from such delays or cancellations, but no cancellation fee will be charged where the cancellation is made by us.

6. Customer Obligations

6.1 The Customer must ensure that:

a. The Waste to be collected is accurately described at the time of booking.

b. The Waste is accessible and ready for collection at the agreed time.

c. Any necessary permissions, permits or authorisations are in place for access to private roads, car parks, gated developments or managed buildings.

d. There is safe and unobstructed access to the Waste, including safe stairways, hallways and passageways.

6.2 The Customer must not present for collection any hazardous, unlawful or prohibited materials such as asbestos, certain chemicals, explosives, medical waste or liquids, unless we have expressly agreed in writing and are properly licensed to handle such items.

6.3 The Customer warrants that they either own the Waste or have full authority from the owner to arrange for its removal and disposal. The Customer agrees to indemnify us against any claim brought by a third party alleging that the removal or disposal of the Waste was not authorised.

7. Waste Regulations and Disposal

7.1 Rubbish Removal Kennington operates in accordance with applicable UK waste management legislation and regulations. We are committed to lawful, safe and responsible handling, transport and disposal of Waste.

7.2 Once the Waste has been loaded onto our vehicle and payment obligations have been met, ownership of the Waste transfers to us and we will arrange its transport and disposal through licensed facilities, including recycling centres and authorised waste transfer stations where appropriate.

7.3 We may, at our sole discretion, refuse to remove any items that we reasonably believe are hazardous, unsafe, illegal to handle, or not in line with the information provided during the booking. We may also refuse items that exceed safe lifting limits or pose a risk to our staff, vehicles or property.

7.4 We will use reasonable efforts to maximise recycling and recovery of materials where practical, in keeping with waste hierarchy principles and our environmental commitments. However, we do not guarantee that any particular item will be recycled and make no representation as to the final destination of specific Waste items.

8. Access, Parking and Property Conditions

8.1 The Customer is responsible for providing suitable parking or entry arrangements for our vehicles as close as reasonably possible to the collection point. Any parking charges, congestion charges or access fees incurred in carrying out the Services may be added to the final invoice.

8.2 The Customer must inform us of any known property risks or restrictions, including fragile surfaces, narrow stairways, low ceilings, unlit areas, or any other hazards that might affect the safe provision of the Services.

8.3 We will take reasonable care when carrying out the Services, but the Customer accepts that minor scuffs or marks may occasionally occur when bulky or heavy items are removed from tight spaces or through narrow access routes. We will not be responsible for normal wear or minor cosmetic damage that is inherent in the nature of the work.

9. Liability and Limitations

9.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where it would be unlawful to exclude or limit liability under applicable law.

9.2 Subject to clause 9.1, our total liability to the Customer arising out of or in connection with the Services or these Terms, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total amount paid or payable by the Customer for the relevant Booking.

9.3 We will not be liable for any loss of profits, loss of business, loss of revenue, loss of opportunity, or any indirect or consequential loss arising in connection with the Services or these Terms.

9.4 We will not be responsible for any items that the Customer intended to keep but which were accidentally included with the Waste. It is the Customer’s responsibility to check items carefully before we remove them. We may, at our discretion, attempt to assist in locating or recovering such items, but we cannot guarantee their return and accept no liability for their loss.

9.5 The Customer is responsible for securing or removing any items not intended for collection that are located near the Waste, and for protecting floors, walls or surfaces where they require extra protection beyond what it is reasonable for us to provide.

10. Insurance

10.1 We maintain appropriate public liability insurance and, where applicable, employer’s liability insurance for the provision of rubbish removal and waste collection services.

10.2 Where the Customer believes damage has occurred during the provision of the Services, this must be reported to us as soon as reasonably practicable and in any event within 48 hours of completion of the work, together with reasonable evidence and details of the alleged damage so that we can investigate.

11. Delays and Events Beyond Our Control

11.1 We will use reasonable endeavours to arrive and complete the Services within the agreed time window. However, timing is not guaranteed and we shall not be liable for delays arising from traffic, weather, accidents, roadworks, enforcement actions, or any other circumstances beyond our reasonable control.

11.2 If an event beyond our control significantly affects our ability to perform the Services, we will contact the Customer as soon as reasonably possible to arrange a revised date or time. If we cannot perform the Services within a reasonable period, either party may cancel the affected Booking without penalty, and we will refund any amount paid for Services not provided.

12. Complaints and Disputes

12.1 We aim to provide reliable and professional rubbish removal services. If the Customer has any concerns or complaints about our Services, these should be raised with us promptly, providing full details of the issue.

12.2 We will investigate any complaint in good faith and will seek to resolve the matter through discussion with the Customer. If a resolution cannot be reached informally, the parties may consider appropriate dispute resolution methods, but nothing in this clause limits any rights either party may have under law to bring a claim before the courts.

13. Data Protection and Privacy

13.1 In providing our Services, we may collect and use personal information about the Customer, such as contact details, property address, billing details and information related to bookings and payments.

13.2 We will handle such information in accordance with applicable UK data protection laws. Information will only be used for legitimate business purposes such as administration of bookings, provision of Services, processing payments and meeting legal obligations.

14. Changes to These Terms

14.1 We may update or revise these Terms and Conditions from time to time. Any changes will take effect from the date they are published or notified and will apply to new Bookings made after that date.

14.2 The Terms and Conditions in force at the time you make a Booking will apply to that Booking, unless we agree another arrangement in writing.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Services, including any non-contractual disputes or claims.

16. General Provisions

16.1 If any provision of these Terms is found by a court or competent authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable, and the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that or any other right or remedy.

16.3 The Customer may not assign or transfer any of their rights or obligations under these Terms without our prior written consent. We may assign or subcontract our rights and obligations where necessary to provide the Services, provided that this does not adversely affect the Customer’s rights.

16.4 These Terms and Conditions constitute the entire agreement between the Customer and Rubbish Removal Kennington in relation to the provision of the Services and supersede any prior understanding, arrangement or representation, whether oral or written.
